Medical Marijuana Use in California Jails, Part 1

On December 21, 2006 the First District Appellate Court of Appeals out of San Francisco, California issued an eleven (11) paged Certified published opinion reversing the criminal conviction of the defendant for a violation of California Penal Code section 4573.5 [bringing a drug into a correctional facility] in the appellate case of People v. Harris, #A111860; appealing from the conviction that occurred in People v. Harris, Lake County Superior Court Case #904562.

Thus creating the 'precedent' of People v. Harris, 145 Cal. App. 4th 1456, 52 Cal.Rptr.3d 577. Making it "Official" and "Perfectly LEGAL" to use medical marijuana in ALL County and/or California State Correctional Facilities!!!!!!!

What happened was that I had again got convicted for "driving without a license". That was my thirteenth arrest, with 12 convictions for "driving without a license" in Lake County at this point.

I was sentenced to serve eight (8) days in the county jail. I 'was' going to appeal the conviction, but changed my mind. I decided to go to jail instead. Why waste the opportunity?

So on April 1, 2005 I sent a "certified" letter to the Lake County "Powers" [Board of Supervisors, District Attorney's Office, Sheriff's Department, and the County Jail Commander]; telling them about my conviction and my special needs as a "lifetime" medicinal user of marijuana ;-)

The "Powers" responded immediately by sending one of their henchmen with a hand delivered letter.

This is the letter that was hand delivered by the henchman!!!!

That "REALLY" pissed me off!!!!!!.
So I responded with another "certified" letter to the "Powers" letting them know that they hadn't said anything to change my mind.

So on April 20, 2005 [Happy 420]; I showed up at the correctional facility with two mason jars containing; 1) 3.05 oz of cannabis oil (hemp oil and cannabis extract), and 2) 72 THC wafers (each wafer has the stopping power of three joints)

Of course I got arrested, tried, and convicted :-(

But, the conviction was reversed because the appeals court found that I was RIGHT All along.

I Think that it Pays to FIGHT for WHAT You believe in.

Healthcare System - Do You Know?

..........For those that know me, I have a tendency to be extremely anti-government and anti "Big Brother".

With all the studying that I've done on this subject, even I never realized just how bad the situation was until I saw "Michael Moore's" movie entitled "Sicko". Its about the HEALTHCARE SYSTEM IN THIS COUNTRY. AND ITS IN REALLY BAAAAAAAAAAAAAD SHAPE!!!!!!!!!!!!!!!!!!!!!!!

Ranked number thirty-seven in the world.

**** Note: It occurred to me that if you aren't supposed to go to the hospital, or are supposed to avoid the hospital as much as possible.... How are you supposed to do this?

Well, other countries practice "preventive medicine". They try to keep you healthy so that you don't get sick as often. Of course that is not the case in this country. Here, they want you to go to the hospital so that you can receive 'less' health care, so that you'll become a repeat customer. So how do you avoid the trap?

Now Ben Stein was just talking about Science not using Intelligent Design to form theories, but don't scientist come from lower schools first? I mean, your education has to start from somewhere. And if the scientist at the top aren't able to factor in the CREATOR in their theories, then the CHILDREN won't have access either unless they LEARN it from their PARENTS.

But can you envision of NATION of GODLESS People. I mean, and Ben Stein made the POINT best, "it would be like Nazi Germany all over again". And there are those who STILL remember the ATROCITIES that were carried out all in the NAME of DARWIN and "SURVIVAL OF THE FITTEST".

Motion to Vacate Federal Conviction

As promised...... This is the Notice of Motion and Motion to Vacate a Federal Criminal Conviction.

[Note - Title 40 United States Code [U.S.C.] section ' 255'has been changed to Title 40 U.S.C. section '3112'.
Any practical use of this document MUST include reference of the change to section '3112'at every reference that is made to section '255'.

Because ' 255' was 'repealed' and recodified any reference to '255' is a reference to a repealed code and as such is null and void.

Therefore reference to ' 3112' must accompany any mention of '255' because '3112' is the new code.

[Note - ' 3112' has no established law (no cases) to support it. It's now considered a POINT to DEBATE and DEFINE.
And that's If someone even tries to use it in Court.

Anyone trying to use it nowadays in Court without reference to ' 255' would have a REALLY hard time PROVING the POINT.

Clever, huh?

Whereas ' 255' has all the case authority. It's been decided looooong ago that this CODE has a certain meaning pertaining to a certain 'thing' [federal jurisdiction] and what its purpose is.

But it's been ' repealed'!!!! so that you can't use it anymore and make 'legal' sense.

Your arguments on that POINT are now invalid, unless you reference section '3112'.

Simply because the CODE that you're referencing has been 'repealed'.

It doesn't matter that both CODES say 'exactly' the same things, word for word.

What matters is that NO case authority will be created from now on that references '255'.

The chain of case authority (case law) is now broken unless both references are made.

So you can't use One Without the Other.

What REALLY happened is that THEY tried to loose '255' all together.

But it's there in the CODES under Constitutional Law. So THEY couldn't just leave it out.]

Partial FEDERAL CIVIL VICTORY over LAKE COUNTY

Hey, I've just got word from the U.S. Northern District that I have a 'claim' on LAKE COUNTY and that we're GOING to COURT!!!!!!



This is a copy of the Court Order that I've just received from the Court on my
civil rights case currently pending in the UNITED STATED DISTRICT COURT OF CALIFORNIA, NORTHERN DISTRICT case #CV 09-3168 SI (pr).



This complaint addresses the denial of medical marijuana in the County Jail and other issues.



I will post the remaining documents that are relevant to this ORDER when they have been 'typed'.

I have (Do) used this document with SUCCESS. I personally don't have any problems with the Federal Government or its listed Agents anymore. I include the IRS in that FAMILY, even though the IRS Really isn't 'officially' part of the Government.

But then, I also USE an International Driver's Permit and a World Service Authority Passport to PROVE my Sovereignty.


I've upgraded the language of this MOTION to INCLUDE the CHANGE in STATUTE from '255' to Title 40 U.S.C. sec. '3112'.
