Medical Marijuana Use in California Jails, Part 1

On December 21, 2006 the First District Appellate Court of Appeals out of San Francisco, California issued an eleven (11) paged Certified published opinion reversing the criminal conviction of the defendant for a violation of California Penal Code section 4573.5 [bringing a drug into a correctional facility] in the appellate case of People v. Harris, #A111860; appealing from the conviction that occurred in People v. Harris, Lake County Superior Court Case #904562.

Thus creating the 'precedent' of People v. Harris, 145 Cal. App. 4th 1456, 52 Cal.Rptr.3d 577. Making it "Official" and "Perfectly LEGAL" to use medical marijuana in
ALL County and/or California State Correctional Facilities!!!!!!!

What happened was that I had again got convicted for "driving without a license". That was my thirteenth arrest, with 12 convictions for "driving without a license" in Lake County at this point.

I was sentenced to serve eight (8) days in the county jail. I 'was' going to appeal the conviction, but changed my mind. I decided to go to jail instead. Why waste the opportunity?

So on April 1, 2005 I sent a "certified" letter to the Lake County "Powers" [Board of Supervisors, District Attorney's Office, Sheriff's Department, and the County Jail Commander]; telling them about my conviction and my special needs as a "lifetime" medicinal user of marijuana ;-)

The "Powers" responded immediately by sending one of their henchmen with a hand delivered letter.

That "REALLY" pissed me off!!!!!!.
So I responded with another "certified" letter to the "Powers" letting them know that they hadn't said anything to change my mind.

So on April 20, 2005 [Happy 420]; I showed up at the correctional facility with two mason jars containing; 1) 3.05 oz of cannabis oil (hemp oil and cannabis extract), and 2) 72 THC wafers (each wafer has the stopping power of three joints)

Of course I got arrested, tried, and convicted :-(

But, the conviction was reversed because the appeals court found that I was RIGHT All along.


I Think that it Pays to FIGHT for WHAT You believe in.
